EL CARISMA SIMBÓLICO DE LA BANCA CENTRAL: DEL SACRIFICIO A LOS RITOS

Los estudios culturales del derecho pueden ofrecernos importantes ideas sobre los rasgos de las instituciones esenciales de un sistema constitucional. Por ello, y sobre la base de los argumentos presentados por Paul Kahn en Making the Case, el presente texto tiene dos objetivos: en primer lugar, busca discutir la función carismática de las cortes. En segundo lugar, pretende trasladar este análisis a la Unión Europea, para estudiar específicamente la función que desempeña el Banco Central Europeo y para determinar en dónde reside su carisma y la legitimad de sus decisiones.

Cultural studies of law offer critical ideas about the features of essential institutions in a constitutional system. Therefore, and in light of the arguments presented by Paul Kahn in Making the case, the present text has two objectives: first, it seeks to discuss the charismatic function of the Courts. Second, it seeks to transfer this analysis to the European Union, specifically to the function played by the European Central Bank, and to determine where its charisma and the legitimacy of its decisions rest.
